Terms of Use
Effective Date: 3rd September 2026 | Last Updated: 22nd September 2026
1. Contractual Relationship & Agreement to Terms
These Terms of Service (the 'Terms' or 'Agreement') constitute a legally binding contract between you and FAFA AI Technology Ltd, governing your access to and use of usefafa.com, the Fafa mobile application, and all services delivered through the Platform.
Fafa is an anonymous wellbeing platform that gives people a safe place to express what they are going through. Users can connect with a caring community, access practical coping resources and speak with licensed therapists when they need professional support. Fafa is built around psychological safety: people should feel able to talk without fear of judgment, exposure or shame.
By installing the application, registering an account, or accessing any Platform feature, you explicitly agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.
2. Eligibility & Safe Use by Minors
Minimum Age Requirement: Individuals under the age of 13 are strictly prohibited from creating accounts, accessing the App, or submitting any information to the Platform.
Safe Use by Minors (Ages 13–17): Minors between the ages of 13 and 17 are welcome to access the Platform. Fafa is a completely anonymous, peer-support and emotional well-being application. Because we ONLY collect email addresses, age and gender strictly for authentication and account recovery (no real names, phone numbers, or offline identifying details are collected), we do not require active parental/guardian verification at the point of registration. This minimizes data collection and ensures that young people in distress can safely seek help pseudonymously without fear of social exposure, stigma, or judgment. For institutional onboarding settings (such as secondary schools), institutional administrators coordinate parental information and disclosures in accordance with standard student counseling policies.
3. Scope of Services & Clinical Disclaimer
Fafa operates as a digital technology portal facilitating peer-support connections, self-care resources, and scheduling links with independent licensed mental health professionals. Users must understand the following clinical boundaries:
- Software Platform Vendor: FAFA AI Technology Ltd is a software vendor and technology architect, not a clinical healthcare provider or hospital. The Platform does not employ counselors directly, and FAFA AI Technology Ltd does not deliver medical or clinical therapy in its capacity as a software operator.
- Independent Clinical Network: All counselors and mentors listed on the Platform operate as independent, certified professionals. Practitioner credentials are verified in partnership with the University of Health and Allied Sciences (UHAS) and registered directly with the Ghana Psychology Council. Clinical liability for therapy sessions rests strictly and exclusively with the practicing clinician, not with FAFA AI Technology Ltd.
IMPORTANT EMERGENCY WARNING: THE PLATFORM IS NOT AN EMERGENCY OR CRISIS INTERVENTION SERVICE. The Fafa App and Website are not designed, licensed, or legally permitted to manage psychiatric crises, acute medical emergencies, or immediate threats of self-harm or suicide. If you are experiencing a severe mental health crisis, please exit this application immediately and visit your nearest hospital emergency unit or contact public emergency services.
4. Crisis Intervention & Life Safety Escalation
To safeguard user life safety while respecting digital boundaries, Fafa maintains specific emergency support features:
- AI Chat Keyword Detection: Inside the AI Chat feature ('Talk to Fafa'), automated keyword detection (detectCrisis) scans chat messages for severe distress indicators. When detected, an immediate emergency banner overlays on screen: 'You're not alone. 💚 Ghana Crisis Line: 0800-111-909' and prioritizes human crisis support guidance.
- Venting Feed Moderation: In the public community venting space (/rants), crisis escalation relies on community post reporting and manual flagging by platform moderators.
- Static Emergency Contacts: The Help & Support page provides a direct emergency telephone dialer (tel:911) for immediate emergency connection.
5. Venting Space Rules & User Code of Conduct
To keep Fafa a safe, welcoming, and psychologically supportive space, all users must abide by the following rules. Violation will result in immediate account suspension or permanent termination:
- No De-Anonymization: You must not attempt to uncover, harvest, or compile the real-world identity, email, or personal details of any other peer user.
- Zero Cyberbullying or Abuse: Harassment, hate speech, stalking, explicit sexual content, or coordinated bullying of peer users or counselors is strictly banned.
- No Commercial Exploitation or Spam: You must not post commercial advertisements, sell medical products, or solicit financial transactions on the Platform.
- No Malicious Interference: Reverse engineering, scraping user logs, or attempting to compromise backend security is strictly prohibited under Ghana's Cybersecurity Act.
6. Payments & Refund Policy
Core peer support forums, self-care resource libraries, and initial community features are provided free of charge to support youth emotional well-being. For paid services, including subsidized private consultations with licensed therapists or premium organizational licensing dashboards, the following terms apply:
- Payment Processing: Payments are securely processed via Paystack (Merchant Provider) using credit cards or Mobile Money (MoMo).
- Payment Facilitator Role: Fafa acts as a Payment Facilitator, collecting funds centrally on behalf of independent counselors.
- Strict Refund Policy: Due to the professional scheduling commitments of clinical practitioners, all bookings and premium dashboard licenses are strictly NON-REFUNDABLE once transaction clearance occurs, except in cases where a counselor cancels a scheduled slot.
7. Account Email & Profile Settings
Users are automatically assigned the pseudonym "Norvi" for interactions on the Platform. Users may customize their avatar within profile settings at any time. Account email addresses are fixed upon registration to preserve device linking, authentication security, and account recovery integrity. Users requiring account modifications or deletion may contact usefafaapp@gmail.com.
8. Intellectual Property Rights
All software code, UI designs, application graphics, algorithms, logos, and curated well-being resources published on usefafa.com and the Fafa mobile app are the exclusive intellectual property of FAFA AI Technology Ltd and its partners.
9. Limitation of Liability & Indemnification
THE PLATFORM IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS WITHOUT WARRANTIES OF ANY KIND. FAFA AI TECHNOLOGY LTD DISCLAIMS ALL LIABILITY FOR SYSTEM DOWNTIME OR THIRD-PARTY CLOUD INFRASTRUCTURE DISRUPTIONS. FAFA AI TECHNOLOGY LTD IS NOT LIABLE FOR MEDICAL DECISIONS OR CLINICAL OUTCOMES DELIVERED BY INDEPENDENT CLINICIANS THROUGH SCHEDULING LINKS. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS FAFA AI TECHNOLOGY LTD FROM CLAIMS ARISING FROM YOUR BREACH OF THESE TERMS.
10. Account Suspension & Termination
We reserve the right, at our sole and absolute discretion, to suspend, restrict, or permanently terminate your account and access to the Platform at any time, without prior notice or liability, if we have reason to believe that you have violated these Terms, breached the peer code of conduct, engaged in de-anonymization attempts, or posed a security risk to the Platform's operations.
You may cancel and close your account at any time by accessing the profile settings in the App or by sending a written deletion request to usefafaapp@gmail.com. Upon account deletion, we will purge your registration email and hashed credentials in accordance with our data minimization schedules.
11. Governing Law & Dispute Resolution
These Terms shall be governed strictly by and construed in accordance with the laws of the Republic of Ghana. Any formal legal dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Ghana.
12. Severability & Entire Agreement
These Terms, alongside the Fafa Privacy Policy, constitute the entire legal agreement between you and FAFA AI Technology Ltd regarding your use of the Platform, superseding any prior verbal or written agreements, negotiations, or pilot guidelines.
If any specific provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction in Ghana, that provision shall be severed from the contract, and the remaining provisions of these Terms shall continue in full force and effect, maintaining their binding contractual power.
13. Changes to the Terms of Service
Only the Board of Directors of FAFA AI Technology Ltd may authorize modifications or updates to this Agreement. We reserve the right to update these Terms at any time to reflect software features, regulatory alignments under Act 843, or corporate adjustments. When updates occur, we will publish the revised document on the Website, update the version number, and send a notification directly within the App.
Your continued use of the Platform after the publication of revised Terms constitutes your explicit and binding acceptance of the updated Agreement.
